Merch by Mike Affiliate Program Terms of Service

Effective Date: August 3, 2026

Welcome to the Merch by Mike Affiliate Program. These Affiliate Terms of Service (“Agreement”) govern your participation in the Merch by Mike Affiliate Program. By applying for or participating in the program, you agree to comply with these terms.

1. Enrollment

To participate in the Merch by Mike Affiliate Program, you must:

Submit a complete affiliate application.
Be at least 18 years old.
Provide accurate and current information.
Maintain an active website, blog, social media account, or other approved promotional platform.

Merch by Mike reserves the right to approve or reject any application at its sole discretion.

2. Affiliate Commission

Approved affiliates earn:

10% commission on qualifying completed sales generated through their unique affiliate referral link.

A qualifying sale is:

Successfully paid
Not canceled
Not refunded
Not charged back
Not identified as fraudulent

Commissions are earned only after an order has been fully processed.

3. Payment Schedule

Affiliate commissions are paid:

Monthly

Payments may be made through:

PayPal

A minimum payout threshold of $ 50.00 may apply.

4. Referral Tracking

Affiliate referrals are tracked using cookies and referral technology.

A referral will only qualify if:

The customer completes the purchase using the affiliate’s tracking link.
The tracking cookie has not expired.
The purchase is not attributed to another affiliate or marketing source.

Merch by Mike cannot guarantee tracking when cookies are disabled, blocked, or deleted.

5. Promotion Rules

Affiliates are expected to promote Merch by Mike honestly, ethically, and professionally.

The following are strictly prohibited:

False or misleading advertising
Misrepresenting products
Fake testimonials or reviews
Spam emails
SMS spam
Automated messaging
Purchasing followers, likes, or fake engagement
Cookie stuffing
Click fraud
Incentivized clicks without approval
Brand impersonation
Creating fake Merch by Mike websites
Creating fake Merch by Mike social media accounts
Pretending to represent Merch by Mike employees
Using deceptive advertising
Posting offensive, hateful, discriminatory, illegal, or inappropriate content

Violation of these rules may result in immediate removal from the program.

6. Paid Advertising Restrictions

Unless written permission is provided, affiliates may NOT:

Bid on “Merch by Mike”
Bid on “MerchByMike”
Bid on misspellings of our brand
Use our trademarks in Google Ads
Use our trademarks in Microsoft Ads
Purchase branded keywords
Use our logo in paid advertisements without permission

Affiliates may advertise generic apparel, fashion, sports, or lifestyle keywords that do not infringe on our trademarks.

7. Coupon Codes

Only official coupon codes supplied by Merch by Mike may be promoted.

Affiliates may not:

Invent coupon codes
Misrepresent discounts
Publish expired offers as active
Promote unauthorized discounts

8. Intellectual Property

Merch by Mike grants affiliates a limited, non-exclusive, revocable license to use approved:

Logos
Product photos
Marketing banners
Promotional graphics
Brand assets

These assets remain the exclusive property of Merch by Mike.

Affiliates may not modify logos, trademarks, or brand identity without written permission.

9. Order Cancellations & Refunds

Commissions are not earned on:

Refunded purchases
Returned merchandise
Fraudulent transactions
Chargebacks
Canceled orders

If a commission has already been paid on an order later refunded, Merch by Mike reserves the right to deduct that amount from future commissions.

10. Affiliate Responsibilities

Affiliates agree to:

Follow all applicable federal, state, and local laws.
Comply with FTC endorsement guidelines.
Clearly disclose affiliate relationships whenever required.
Protect customer privacy.
Maintain accurate account information.

11. FTC Disclosure

Affiliates must clearly disclose that they may receive a commission from qualifying purchases.

Example disclosure:

“As a Merch by Mike Affiliate, I may earn a commission from qualifying purchases at no additional cost to you.”

Failure to provide required disclosures may result in termination.

12. Termination

Merch by Mike may suspend or terminate an affiliate account at any time for violations including, but not limited to:

Fraud
Spam
Trademark abuse
Fake referrals
Deceptive marketing
Misrepresentation
Abuse of the affiliate platform
Violation of these Terms

Upon termination:

Referral links may be disabled.
Future commissions may be forfeited if earned through prohibited activities.
Marketing materials must no longer be used.

13. Modification of Terms

Merch by Mike reserves the right to modify these Terms of Service at any time.

Continued participation in the Affiliate Program constitutes acceptance of the updated terms.

14. Limitation of Liability

Merch by Mike shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from participation in the Affiliate Program.

Participation is at your own risk.

15. Governing Law

This Agreement shall be governed by the laws of the State of California, without regard to conflict of law principles.
